Terms and Conditions
1. Scope and Contracting Party
These Terms and Conditions apply to orders placed through the Boox Store online shop.
The contracting party is:
Boox Store
Online sales and service for professional mobile and digital solutions
Owner: Dipl.-Ing. Waldemar Luft
Selbecker Str. 83
32825 Blomberg
Germany
Email: support@boox.store
A consumer is any natural person who enters into a transaction primarily for purposes that cannot be attributed to their commercial or independent professional activity. A business customer is a natural or legal person or partnership with legal capacity acting in the course of its commercial or independent professional activity.
2. Orders and Conclusion of Contract
The presentation of products in our online shop does not constitute a binding offer to conclude a contract.
Customers can place products in the shopping cart and review and correct their information before submitting the order. By activating the final order button, the customer submits a binding order for the products contained in the shopping cart.
The automatic confirmation sent immediately after an order initially confirms receipt of the order. The purchase contract is concluded when we expressly accept the order, confirm dispatch or dispatch the goods. Where a particular payment method results in conclusion of the contract during the payment process, the conditions displayed for that payment method apply.
The contract language is German or English according to the language used in the shop when the order is placed.
3. Prices and Payment
Prices displayed in the shop include the legally applicable VAT where VAT applies to the respective transaction. Shipping costs are shown separately before the order is submitted.
Available payment methods may include bank transfer, PayPal and supported credit or debit card payments through a payment service provider. The payment methods actually available for an order are displayed during checkout.
For payment by bank transfer, the order will normally be processed after the payment has been received and allocated to the order unless otherwise agreed.
4. Delivery and Shipping
Available shipping methods, shipping charges and any stated delivery times are displayed in the online shop or during checkout.
In-stock and paid orders are generally dispatched within 24 hours. Processing may take longer during periods of exceptionally high demand, following new product launches or for pre-orders.
Partial deliveries may be made where reasonable for the customer. Customers will not incur additional shipping charges for partial deliveries initiated by us.
For consumers, the risk of accidental loss or deterioration generally passes to the consumer only when the goods are delivered to the consumer or a recipient designated by the consumer. Statutory exceptions remain unaffected.
For business customers, the statutory provisions governing transfer of risk in shipment contracts apply.
5. Deliveries outside the European Union
Deliveries to countries outside the European Union may be subject to import duties, taxes, customs clearance charges or other charges imposed in the destination country.
Unless expressly stated otherwise during checkout, such charges are not included in the purchase price or shipping costs. The recipient is responsible for the lawful importation of the goods and for charges imposed in the destination country.
If the recipient refuses a properly dispatched non-EU shipment because of import charges or for other reasons attributable to the recipient, actual return transportation, customs and handling costs may be deducted from any refund to the extent permitted by law.
6. Retention of Title
The goods remain our property until payment has been made in full.
For business customers, we retain title to the goods until all claims arising from the ongoing business relationship have been settled in full.
7. Right of Withdrawal for Consumers
Consumers have the statutory right of withdrawal. Details regarding the right of withdrawal, the withdrawal period, the effects of withdrawal and the model withdrawal form can be found on our “Right of Withdrawal” page.
Business customers do not have a statutory right of withdrawal.
8. Defects and Statutory Warranty Rights
Consumers are entitled to the statutory rights relating to defective goods.
If goods are defective, consumers are in particular entitled to statutory remedies including subsequent performance and, where the legal requirements are met, price reduction, withdrawal from the contract or damages.
Transport, travel, labour and material expenses required for statutory subsequent performance will be borne by us to the extent required by law. Customers should contact our service department before returning defective goods so that the return and an appropriate shipping method can be arranged.
Any additional manufacturer's warranty or voluntary seller's warranty applies only where expressly stated for the respective product. Such a warranty does not restrict statutory rights relating to defects.
9. Special Provisions for Business Customers
The statutory consumer right of withdrawal does not apply to purchases made by business customers.
Where the customer is a merchant, statutory inspection and notification obligations apply.
To the extent legally permissible and unless otherwise expressly agreed, the limitation period for claims relating to defects in new goods sold to business customers is one year from delivery. This does not apply where mandatory statutory liability applies, including in particular cases of intent, gross negligence, injury to life, body or health or other cases in which limitation is not legally permitted.
10. Service and Returns
Before returning a device because of a technical problem, customers should contact our customer service department. Many technical issues can be resolved without returning the device.
Before returning a device, personal data and user accounts should be removed where possible and important data should be backed up. We are not liable for loss of data unless the loss results from a breach of duty for which we are responsible.
Goods must be adequately packaged for safe transportation. Use of the original packaging is recommended where it is still available, but is not a condition for exercising statutory consumer rights.
11. Liability
We are liable for damages in accordance with the applicable statutory provisions where liability is mandatory by law.
Mandatory provisions of product liability law remain unaffected.
12. Data Protection
Information concerning the processing of personal data is provided in our separate Privacy Policy.
13. Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
14. Jurisdiction for Business Customers
Where the customer is a merchant, a legal entity under public law or a special fund under public law, our registered place of business shall be the place of jurisdiction for disputes arising from the contractual relationship to the extent such an agreement is legally permissible.
